1. Acceptance of Terms

Welcome to Philippines Adventures. By booking or participating in any of our adventure tourism activities, you agree to be bound by these Terms and Conditions. If you do not agree with any of these terms, please do not use our services.

3. Definitions

For the purposes of these terms and conditions:

• "The Company" or "We": Refers to Philippines Adventures Inc.
• "Client" or "You": Person who books or participates in our activities.
• "Adventure Activity": Any program, tour or experience offered by Philippines Adventures.
• "Guide": Certified professional assigned to lead activities.
• "Equipment": Technical and safety material provided for activities.

4. Services Offered

Philippines Adventures offers the following categories of activities:

4.1 Water Activities

• Island hopping tours
• Scuba diving and snorkeling
• Kayaking in lagoons and bays
• Surfing lessons and tours

4.2 Aerial Activities

• Parasailing
• Skydiving experiences
• Zipline adventures

4.3. Land Activities

• Rice terrace trekking
• Mountain hiking and climbing
• ATV and off-road adventures
• Canyoneering

5. Fees and Payments

5.1 Prices

All prices are expressed in Philippine pesos (PHP) and include VAT when applicable.

5.2 What Fees Include

• Certified safety equipment
• Certified professional guides
• Accident insurance during the activity
• Transportation from designated meeting points (depending on activity)
• Snacks or meals (when specified)
• Entrance to parks or protected areas

5.3 What Fees Do NOT Include

• Transportation from your hotel to the meeting point (except when specified)
• Additional food not mentioned
• Tips for guides (optional but appreciated)
• Personal expenses
• Travel medical insurance (recommended)

5.4 Payment Methods

We accept the following payment methods:

• Credit cards: Visa, MasterCard, American Express
• Debit cards
• Bank transfer
• Cash (only at our offices)
• GCash, PayMaya, PayMongo

5.5 Booking Policy

• To confirm your booking, a deposit of 50% of the total value is required.
• The remaining balance must be paid 48 hours before the activity.
• Bookings without full payment may be automatically cancelled.
• Group discount (5+ people): 10% off
• Early booking discount (30+ days): 15% off

6. Cancellation and Refund Policy

Philippines Adventures reserves the right to cancel activities due to:

• Adverse weather conditions that compromise safety
• Insufficient number of participants (minimum 4 people for some activities)
• Technical problems with safety equipment
• Order from competent authority

In these cases, we offer full refund or rescheduling at no additional cost.

6.3 Rescheduling

• You can reschedule with more than 7 days notice at no cost.
• Rescheduling with less than 7 days notice: 20% charge of total value.
• Only one free rescheduling is allowed per booking.

7. Participation Requirements and Restrictions

7.1 General Requirements

• Minimum age: 12 years for moderate activities, 18 years for extreme activities (with exceptions as applicable).
• Minors: Must be accompanied by a responsible adult and present notarized parental authorization.
• Health status: Physical condition adequate for the activity. Consult with your doctor if in doubt.
• Maximum weight: 120 kg for parasailing, 100 kg for some water activities.
• Swimming ability: Mandatory for water activities.

7.2 Medical Restrictions

People with the following conditions cannot participate:

• Serious heart problems
• Uncontrolled epilepsy
• Pregnancy
• Recent surgeries (less than 6 months)
• Spinal injuries
• Severe uncontrolled asthma
• Untreated blood pressure problems

7.3 Sobriety Status

It is strictly prohibited to participate in activities under the influence of alcohol or drugs. We reserve the right to deny service without refund to people who do not comply with this condition.

8. Responsibilities and Assumption of Risks

8.1 Assumption of Risks

By participating in our adventure activities, you acknowledge and accept that these activities carry inherent risks, including but not limited to: physical injuries, property damage, and even death. You voluntarily assume these risks.

8.2 Client Responsibility

The client agrees to:

• Follow all guide instructions
• Use the safety equipment provided correctly
• Report any relevant medical conditions
• Not perform reckless or dangerous actions
• Respect the environment and local culture
• Arrive punctually at the meeting point

8.3 Responsibility of Philippines Adventures

We are committed to:

• Provide certified and experienced guides
• Supply safety equipment in good condition and certified
• Conduct risk assessments before each activity
• Maintain liability and accident insurance
• Act according to industry best practices

8.4 Limits of Liability

Philippines Adventures will not be liable for injuries or damages caused by failure to follow instructions, participant negligence, undeclared medical conditions, or force majeure events.

9. Insurance

9.1 Insurance Included

All our activities include:

• Personal accident insurance during the activity
• Coverage of emergency medical expenses up to ₱500,000 PHP
• Emergency medical evacuation

9.2 Additional Insurance Recommended

We strongly recommend purchasing international travel insurance that covers adventure activities if you are a foreign tourist.

10. Equipment and Materials

• All equipment is property of Philippines Adventures and must be returned in the same condition.
• Damage or loss caused by negligence will be charged to the client.
• You can bring your own equipment if it is certified and approved by our guides.
• We recommend comfortable clothing, sunscreen, and appropriate footwear.

11. Photographs and Videos

During activities, our team may take photographs and videos for marketing purposes. By participating, you authorize the use of your image in our promotional channels. If you do not wish to appear, inform us in writing.

12. Personal Data Protection

The processing of your personal data is governed by our Privacy Policy, in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173).

13. Sustainability and Environment

Philippines Adventures is committed to sustainable tourism:

• We respect protected areas and local communities
• We practice the "Leave No Trace" principle
• We support environmental conservation projects
• We employ trained local guides

14. Code of Conduct

We reserve the right to expel without refund participants who:

• Show aggressive or disrespectful behavior
• Endanger other participants
• Intentionally damage the environment
• Do not follow safety instructions
• Consume illicit substances

15. Force Majeure

We will not be liable for non-compliance due to events beyond our reasonable control, including: natural disasters, pandemics, wars, civil unrest, strikes, or government decisions.

16. Applicable Law and Jurisdiction

These terms are governed by the laws of the Republic of the Philippines. Any dispute will be resolved in the courts of Makati City, Metro Manila, Philippines.

17. Modifications

We reserve the right to modify these terms at any time. Changes will be published on our website and take effect immediately.
